Terms of Service

1. Acceptance of Terms

By accessing or using ListMyCar (the “Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. What ListMyCar Is

ListMyCar is a tool for private-party car sellers. It helps you decode a VIN, polish photos, draft a listing description, and publish a shareable listing page. ListMyCar is not a dealer, broker, or marketplace. We do not buy, sell, or take custody of vehicles. Any sale happens directly between you and a buyer, on your terms.

3. Eligibility and Accounts

You must be at least 18 years old to use the Service. You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for everything that happens under your account.

4. Your Listing Content

You retain ownership of the photos, text, vehicle details, and other content you upload (“User Content”). By using the Service, you grant ListMyCar a non-exclusive, worldwide, royalty-free license to store, display, and process your User Content solely to operate the Service and show your listing to the people you share it with.

You represent that you have the right to upload each piece of User Content, that it accurately describes the vehicle, and that publishing it does not violate any law or third-party right. You are responsible for your listing.

5. Acceptable Use

You agree not to:

  • List a vehicle you do not own or have authorization to sell;
  • Misrepresent a vehicle's condition, history, or title status;
  • Upload images you do not have the rights to use;
  • Use the Service to harass, defraud, or harm any person;
  • Attempt to reverse-engineer, scrape at scale, or disrupt the Service.

6. Fees and Payment

Paid features are billed through our payment processor. Unless stated otherwise at checkout, listing fees are non-refundable once a listing has been generated and published. You authorize us to charge the payment method you provide.

7. AI-Generated Content

The Service uses AI to polish photos, suggest prices, and draft listing descriptions from facts you provide. You are responsible for reviewing AI-generated output before publishing and for the final listing. Price suggestions are estimates, not guarantees of sale value.

8. Intellectual Property

The Service, including its software, design, and branding, is owned by ListMyCar, Inc. and protected by intellectual-property laws. You may not copy, resell, or create derivative works from the Service itself.

9. Changes and Termination

We may modify, suspend, or discontinue the Service, or change pricing and features, at any time. We may suspend or terminate your access if you violate these Terms. You may stop using the Service at any time; sections that by their nature should survive termination (ownership, disclaimers, liability limits, dispute resolution) will survive.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or suitable for your specific vehicle. We make no representations about the behavior of buyers who contact you through a listing.

11. Limitation of Liability

To the maximum extent permitted by law, ListMyCar is not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, lost sales, or lost data. Our total liability to you for any claim arising from the Service is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute arising from or relating to the Service will be resolved by binding individual arbitration, except that either party may bring a claim in small-claims court if eligible. You waive the right to participate in a class action.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted to this page with a new effective date. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
